KONSTRUKSI HUKUM TERHADAP PERJANJIAN PAKET WISATA ANTARA BIRO PERJALANAN WISATA PT. BINTANG WISATA TOUR DENGAN PENUMPANG

Abstrak

Article 1 paragraph 1 of Law No.10 of 2009, tourism is a travel activity carried out by a person or group of people by visiting certain places for the purpose of recreation, personal development, or learning the uniqueness of tourist attractions visited in a temporary period. Land travel agreements using land vehicles in the form of buses are not known in Book III  KUHPerdata or KUHD. The purpose of this study is to determine the legal construction of the relationship held by PT Bintang Wisata Tour as a travel agent with passengers using tourist services. This research method uses normative juridical, the research specification is descriptive. The data presentation method is presented in the form of systematic descriptions. The conclusion is that the legal construction of the relationship between PT Bintang Wisata Tour and passengers is included in the agreement to perform certain services, namely the tour package agreement in which PT Bintang Wisata Tour binds itself to carry out services or transportation work, food / drink accommodation, hotels, and enjoy tourist objects / attractions in the framework of organizing tours, and passengers to pay for tour / tour fees.
