Abstrak

Electronic Signature is a signature that consists of Electronic Information that is embedded, associated or related to other Electronic Information that is used as a verification and authentication tool. Electronic signatures (hereinafter referred to as electronic signature) are regulated in the Electronic Information and Transaction and Government Regulation no. 71/2019 concerning implementation of Electronic Systems and Transactions (hereinafter referred to as PP PSTE). Electronic Signature is widely used in Indonesia, especially in terms of signatures in agreements. The benefit of electronic signature is to save time if one of the parties is unable to sign a signature but it can also create potential for legal violations if misused. The formulation of the problems in this paper are: first, what are the challenges in using electronic signatures in Indonesia? Second, what are the benefits of electronic signatures in Indonesia? The writing method is the normative juridical legal writing method. Using qualitative analysis methods using secondary data, in the form of laws and regulations and scientific articles, newspaper articles about electronic sigantures. The conclusion is that first, the use of electronic signatures must be implemented based on dignified justice, beneficial to the parties and if a dispute occurs, it can also be resolved in a win-win solution. The challenge of using electronic signatures is from the side of the provider of electronic signatures, that consumers still do not know who is the organizer of electronic signatures in Indonesia, the two benefits of electronic signatures are numerous, especially related to legal documents such as under-handed agreements or making authentic deeds.
