Abstrak

Folk mining permit as a legal basis for conducting mining activities of the people, meaning that without having a permit people are not allowed to do mining. East Belitung Regency is the only Regency in the Bangka Belitung Islands, which since 2011 has been issued a People's Mining License through East Belitung Regent Regulation Number 23 of 2011. Based on the existing conditions, changes based on Regent Regulations cannot be implemented. This is indicated because it does not involve local wisdom. The above phenomenon must get serious attention because managing resources in the region must be able to provide the welfare of the people in the region. The purpose of this study is to reveal and analyze the importance of community participation in local wisdom value mining permit and then offer a new construction design, namely community participation in local wisdom value mining licensing in East Belitung Regency. This study uses a socio-legal approach. The socio-legal research tradition always peels and finishes the normative framework of a problem first, because it is practical to understand its complex situation so normative studies are carried out first, so that the other sides of the texts, norms, and doctrinal works of law are completely demolished. especially local wisdom.
