Abstrak

In fact that  carrying out its operations, the company does not always show the development and increase some profit (profit), because the risks that arise from the business, be it investment risk, financing risk and operating risk.

 All the risks can be threaten  the company's finances  sustainability and the most fatal company can go bankrupt (bankrupt) because it can not pay all the debt obligations of the company. the problem that arises from the background above is how the legal protection of labourer on the bankrupt companies as a Human Rights embodiment  in the economic field. The methodology  is descriptive normative. The Legal protection of labourer's rights as creditors as stipulated in the provisions of Article 165 of Law Number 13 of 2003 regarding about the businessman can terminate the labourers  because of a bankrupt company, by the rule that  labourers are entitled to severance pay for 1 time the provisions of Article 156 paragraph 3, and compensation money according to the provisions of Article 156 paragraph 4. This provision is also stipulated in Article 39 paragraph 1 of Law Number 37 of 2004 concerning Bankruptcy and Suspension of Debt Payment Obligations.
